    Abstract: 弊端揭發人(whistle-blower)是對組織不法情事進行舉發之內部成員,因為其熟悉機關內部且較易取得弊端資訊的特性,因此被認為是防止弊端最有效且也是最後之防線。然而弊端揭發人基於道德勇氣檢舉不法,卻經常受到機關鋪天蓋地而來的各種手段加以報復,因而我國匿名檢舉之比例高居不下。我國現行對揭弊人保護的機制不夠完善,弊端揭發相關的權責分散,以及弊端揭發人相關法律條文模糊,使檢舉管道、保護與保密規定晦暗不明,讓揭弊者心生退卻。
